Erik R. Anderson concentrates his practice on complex commercial, governmental, and employment litigation, attorney and law firm defense, government investigations, and internal investigations. He is routinely engaged by companies, executives, high-ranking public officials and government institutions, law firms and attorneys, and other professionals ensnared in the legal process — often under the intense glare of professional, reputational, political, or media scrutiny.
Erik has represented elected or appointed officials — from both sides of the aisle — from each branch of Pennsylvania state government, each Chamber of the Pennsylvania General Assembly, and the General Assembly itself in civil, appellate, criminal, or administrative proceedings. He also has considerable experience briefing and arguing constitutional issues before state and federal trial and appellate courts.
Erik has obtained Martindale-Hubbell’s highest peer rating, AV Preeminent. This rating is given to attorneys whose peers rank them at the highest level of professional excellence for their legal expertise, communication skills, and ethical standards. Likewise, The Best Lawyers in America© recognized Erik in its 2022 and 2023 editions for Commercial Litigation. In commercial matters, Erik represents plaintiffs and defendants in diverse disputes in federal and state courts and various arbitration forums. For instance, Erik has handled employment, fraud, corporate governance, breach of fiduciary duty, defamation, intellectual property, breach of contract, partnership disputes, Lanham Act, trade secrets, restrictive covenants, unfair trade practices, and energy litigation. Erik has also helped clients avoid the cost and risks of courtroom battles by achieving highly favorable pre-suit and pretrial outcomes.
In criminal matters, Erik defends companies and individuals in white-collar government investigations, regulatory enforcement proceedings, federal and state grand jury investigations, and trials. His white-collar representations have included high-profile public corruption cases and a number of confidential matters where charges were avoided.
Erik is regularly called on to conduct sensitive internal investigations for law firms, businesses, government agencies, and religious institutions.
In his legal profession and ethics practice, Erik defends attorneys and law firms responding to ethics inquiries and defends against prosecutions brought by the Office of Disciplinary Counsel.
Before joining Post & Schell, Erik practiced for five years as the lead attorney in the Harrisburg office of Myers, Brier & Kelly, LLP. Before that, he spent nearly a decade in government service, first as a Deputy Chief Counsel with the Pennsylvania General Assembly and then as a Deputy Attorney General with the Pennsylvania Office of Attorney General.
