Rich McMonigle Quoted in Dec. 18 Legal Intelligencer Article Examining a PA Supreme Court Ruling's Impact on Bad Faith Claims
The December 18 article examines the impact of the Pennsylvania Supreme Court's decision in Allstate Property and Casualty Insurance vs. Wolfe on bad faith claims. Insurance Law Principal Richard L. McMonigle, Jr. notes that while the Court's decision may settle related Pennsylvania law, he does not expect it to "greatly alter practice."
Mr. McMonigle explains:
"I think policyholders have been fairly routinely including Section 8371 claims along with common law bad-faith claims.I thought the common law bad-faith and the excess verdict exposure was a sufficient impetus for doing the right thing, so I do not believe the Wolfe decision will significantly affect insurers in what they do."
