Pennsylvania Department of State Board Counsel Kerry E. Maloney Joins Post & Schell as a Principal in its Harrisburg Office


Harrisburg, PA – August 28, 2019 – Post & Schell, P.C. is pleased to announce that Kerry E. Maloney has joined the Firm as a Principal in its Professional Licensure and Regulatory & Administrative Agency Law practice groups in its Harrisburg, PA office.

An experienced litigator and healthcare and regulatory attorney with government, military, and private practice experience, Mr. Maloney represents and defends a variety of medical professionals, including doctors, nurses, dentists, pharmacists, and chiropractors, in Pennsylvania professional licensure matters. This includes investigations and hearings before state boards regarding license applications, as well as disciplinary actions.

He has a detailed knowledge of Pennsylvania's regulatory structure and state professional licensure systems from his 17 years serving in the Pennsylvania Department of State. Most recently, Mr. Maloney served as Board Counsel, providing legal counsel, regulatory guidance, and appellate representation for, among others, the State Boards of Medicine, Pharmacy, Dentistry, and Chiropractic. His counsel included issues of discipline , scope of practice, duty to report, promulgating of regulations, and drafting adjudications. He also interacted with state agencies, including the Pennsylvania Departments of Health, Human Services, and Aging, as well as the Pennsylvania Office of Attorney General.

In addition to his government experience, Mr. Maloney recently retired from the U.S. Army Reserve as a Lieutenant Colonel in the U.S. Army Judge Advocate General’s Corps. During his over 10 years of active duty service, he served as the principal legal adviser to the Commandant of the Army War College for issues including ethics, healthcare, criminal, and administrative law. He also served as an Appellate Branch Chief, representing the United States in criminal appellate cases.
