In the article, "A Dozen Years After Birth Center, the Third Party Bad Faith Claim Continues to Expand," Insurance Law Principal and author of the book, Insurance Bad Faith in Pennsylvania, Richard L. McMonigle, Jr., notes that: "With the 1990 enactment of Pennsylvania's bad faith statute...and more particularly with the Pennsylvania Supreme Court decision in Birth Center v. St. Paul Companies, Inc., the third party bad faith claim has, whether rightly or wrongly, been the subject of expansion by the courts."
