Post & Schell’s Energy & Utilities Practice Group assists clients in a broad range of regulatory, litigation, and transactional matters involving the electric, natural gas, oil and liquids pipelines, renewable/alternative energy, water/wastewater, and Marcellus shale industries. Our clients include three of Pennsylvania’s largest electric utilities, most of Pennsylvania’s natural gas distribution utilities, several major water/wastewater utilities, and the majority of Pennsylvania’s utilities, as well as energy trade associations and interstate pipelines across the United States. Our Group’s attorneys have extensive experience before the Federal Energy Regulatory Commission (FERC), U.S. Department of Energy, U.S. Department of Transportation, the Pennsylvania Public Utility Commission (PA PUC), and other state public utility commissions and courts. They include attorneys who have previously clerked for federal and state appellate judges. We have a trained group of lawyers capable of providing services to our clients over the long term.

Before the PA PUC, our attorneys have represented utilities of all service types in numerous base rate increase requests, long term infrastructure and distribution improvement charge filings, safety and incident investigations, retail supply competition, approvals to start new public utilities, transactions with affiliates, and major financings. We provide counsel and advice on potential legislation and proposed regulations. We have extensive experience with multiple electric utilities in obtaining approvals for siting high voltage electric transmission lines. We also have assisted clients regarding regulation of ride sharing and other transportation companies.

We also have represented and advised major utilities, and the present and future owners of utilities, in obtaining regulatory approvals for the sale and purchase of entire utility companies, substantial assets of those companies, and other significant ownership changes. We frequently work closely with transactional firms to plan for and obtain the necessary regulatory approvals associated with a transaction’s objectives. Our attorneys seek to understand our clients’ businesses and use their extensive industry experience and knowledge to develop creative, cost effective solutions to achieve client objectives.

At the federal level, our attorneys represent pipelines and utilities under the Natural Gas Act and the Interstate Commerce Act in rate and tariff filings, petitions for declaratory order, certificate proceedings, rulemakings, Presidential Permits, gathering exemptions, Hinshaw pipeline rates, intrastate pipeline operating statements, FERC compliance matters, and related appellate proceedings. We have extensive experience with cost-of-service ratemaking, regulated tariff rate filings, market-based rate filings, utility interconnection, energy efficiency, renewable energy credits, energy procurement, and electric, natural gas, and petroleum pipeline safety matters. 

We also partner with Post & Schell’s other practice groups and attorneys to address the full range of our energy and utility clients’ legal needs. These include our colleagues in the firm’s Labor and Employment, Internal Investigations and White Collar Defense, Casualty and General Liability Litigation, Environmental, Construction, Corporate, and Commercial Litigation Practice Groups.
