In the 2023 edition of the Legal Intelligencer's Construction Law Supplement, Paul A. Logan and Ryan M. Logan examine the Build America, Buy America Act's (BABA) requirements for federal infrastructure projects in the article "Federal Infrastructure Projects and the Requirements of 'BABA',"
The authors note:
"BABA currently requires the cost of the components of the manufactured product to exceed 60% of the total cost of all components. But the Act became effective before the adoption of regulatory guidance, so there is a significant 'catch-up' effort to provide guidance for BABA contracts, including those currently underway."
